In this page you’ll find the terms and conditions on which we supply any of the products (Products) listed on our website located at www.smartsystem.com to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by using our site or ordering any of our Products, you agree to be bound by these terms and conditions.

Warranty

All SmartSystem products have a free of charge one(1) year warranty. Registering your product at care.smartsystem.com within 30 days from date of first purchase/invoice will extend the basic warranty as reported here.

SmartSystem warrants that the product supplied will – under proper use – be free from defects in workmanship and materials and agrees that it will, at its option, either repair or replace any defective part within duration of warranty from date of first purchase with no labor charge.
This warranty does not apply to any SmartSystem product that has been abused, misused, operated contrary to instructions for use, neglected, had normal wear or tear, modified or changed in design or construction or serviced by unauthorized parties.
Repairs or misuse by any unauthorized parties will void this warranty.
Warranty claims must be submitted – in writing – to the factory for verification or to an authorized distributor/dealer designated and authorized by SmartSystem.
It is the end user’s responsibility when ordering to ensure that the products ordered conform to his requirements.
All implied warranties are limited to the time period set forth herein & subject to change without notice. No liability can be accepted for any variation.

Limitation of Liability

SmartSystem shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site. Read carefully and comply to the Instruction manual (physical or virtual by downloading it from our website)

Notice

We never spam your email address you gave to us during the Checkout process. We could deliver notice to you by means of e-mail or a general notice on the site or in any reliable method in order to warn you about new features, products or offers.

Indemnification

You agree to indemnify, defend, and hold harmless SmartSystem Srl, its officers, directors, employees, agents, licensors and suppliers (collectively the “Service Providers”) from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Billing Address different than Shipping Address

We can’t verify every order we receive. It’s up to the customer giving to us the right information about the shipment address as well as the billing address and the company information.

Order Shipment

Every day there are packages in departure from SmartSystem warehouse. We’ll try to serve your order within 1 or 2 working days, except for momentarily out of stock. In case of out of stock products, we will send a written notice via email to the email address the customer reported on the order form informing the shipment timing. Orders ship Monday – Friday, excluding holidays, unless otherwise noted.

Stock Management

SmartSystem website is connected directly to our warehouse in order to give to the customer the real availability of every products. Since we sell also in direct way to our retailers or distributors around the world, the stock offered on the website could be not aligned to the real stock situation. In the case a component ordered by a customer is not available, we’ll promptly inform the customer during office time (8.30am : 12.30am – 2.30pm : 6:30pm GMT+1). We apologize for any inconvenience.

Custom Fees

The international orders delivered outside the EU may be subject to import duties and taxes which are calculated when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes since it is impossible to have control over these charges. We are not able to predict their amount. Please contact your local customs office for further information before placing your order. If you need, our accounting office can give to you the right TARIC code for the product you are interested to.

Approval reserve

We believe in our products. Entirely. For this reason we give to you up to 14 days to test with your hand our products. Within this period, if you find that something fall short on performance or quality, contact us for an RMA# in order to be able to send your order back. Please check it out the Product Returns, Restocking Fees and Refund Policy paragraphs.

Product Returns

The returned items must  be shipped with a valid Merchandise Authorization Number (RMA#). Please, contact us by phone of via email in order to received the RMA# before ship the product back to SmartSystem. All returns must be packaged exactly as received i.e. in their original box.  All shipping cost associated with the return is at the responsibility and at charge of the customer. Returns are not accepted for special order items. The returned items must be shipped to :

Restocking Fees

SmartSystem  reserves the right to verify that the returned product is in a perfect working condition without scratches or whatever. We reserve the right to apply minimum of a 20% re-stocking fee, if it is not in re-sellable, like new condition.

Refund Policy

Within the period of 14 days and only after the delivery of goods ordered,  as cooling off period, the customer has the right to request a full purchase price refund (shipment costs excluded) if the products ordered fall short on performance or quality. In order to obtain the refund, the customer must request an #RMA code directly from SmartSystem and the products must :

  • be returned in their original package, without scratches and in a like new condition without missing components or accessories
  • be shipped with only one shipment. The seller reserves the right to don’t accept the products related to a single order shipped in different periods.
  • be a product fully manufactured by SmartSystem without components manufactured and warranted by third parties. Check this page for more detailed information.

The shipping costs for returning the products and any other relevant amount , such as local taxes , customs duties , import and / or customs clearance are borne by the customer and will be deducted from the final payment if requested to SmartSystem. You can check this page for more detailed information about refund process.

Law and Jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed only by the Italian law. The competent court for any dispute or claim arising out is “Tribunale di Pesaro” – Pesaro – ITALY

ODR (Online Dispute Resolution)

Based on the provisions of art. no. 14 of the EU Regulation no. 524/2013, the User is informed that he has the right to access the European online dispute resolution platform (the European ODR Platform) for the resolution of any dispute between Seller and Consumer. The European ODR Platform was developed and is managed by the European Commission, in compliance with Directive 2013/11 / EU and EU Regulation no. 524/2013 in order to facilitate an out-of-court, independent, impartial, transparent, effective, rapid and fair resolution of disputes relating to contractual obligations deriving from sales contracts or online services between a Consumer resident in the European Union and a professional established in European Union through the intervention of an adhering ADR (alternative dispute resolution) body, which can be selected from a specific list available there. In case of non-participation in the conciliation attempt referred to in this paragraph or in the event that the attempt should be unsuccessful, for any dispute relating to the application, execution and interpretation of these General Conditions of Sale, when the User is also Consumer, the competent court is “Tribunale di Pesaro” – Pesaro – ITALY.
